Fabian Henderson, the Brooklyn man who threw a 1-year-old dog off a roof this summer, failed to show up for his sentencing yesterday — thereby voiding the plea agreement that would have spared him from serving jail time.

Henderson, 20, pleaded guilty last month to aggravated animal cruelty, and in exchange got a deal that banned him from owning a dog again but allowed him to remain free. Skipping court, though, means there is now a warrant out for Henderson’s arrest, and he could now face up to four years in jail, the New York Daily News reported.

“What do you expect from somebody who would throw a dog off a roof,” said one of the animal rights activists who attended the sentencing hearing.

In June, Henderson threw his pit bull-terrier mix, Oreo, off the roof of a six-story Red Hook public housing project. The dog survived injuries that included shattered legs, bruised lungs and internal bleeding, but last month ASPCA officials had the dog euthanized because she had become too aggressive.

A dog breeder who abandoned 99 St. Bernards to go on vacation has been sentenced to 18 weeks for animal cruelty.

Mary Collis, 51, admitted to seven counts of causing unnecessary suffering to 85 dogs and failing to meet the needs of 14 dogs at an earlier hearing, according to a BBC report.

Collis, a trained veterinary nurse, was also banned from keeping any animals for 10 years.

One of the 99 St. Bernards had to be put to sleep the night they were found, nearly a year ago. Another died the following day at a vets. Twelve more died after that, as a result of their abandonment, according to testimony. The remaining 83 dogs have since been adopted after a campaign by the RSPCA.

Collis, who had declared bankruptcy in 2007 and was facing eviction, abandoned the dogs to go on vacation with her partner. RSPCA inspectors and police went into the kennels five days later, after receiving public complaints.

The college student accused of taping her boyfriend’s dog to a refrigerator will be allowed to spend the summer at her mother’s home in Chicago — even though her mother has a dog, a judge has ruled.

Abby Toll, 20, an environmental design major at the University of Colorado, will be required to participate in a monitored sobriety program in Chicago as a condition of her release on bond. “I think the defendant’s mother can look out for the family pet,” a judge in Boulder said.

Toll was arrested in April on suspicion of felony animal cruelty. She is accused of binding her boyfriend’s 2-year-old shiba inu, Rex, in packing tape and sticking him upside down to the refrigerator during an argument. She also faces a felony charge of drug possession after police said was found with a trace amount of heroin while being booked into jail.

Her boyfriend, Bryan Beck, also faces a misdemeanor charge of animal cruelty. He is scheduled to appear in court for a pre-trial conference Thursday, according to Coloradodaily.com.

Rex is living with a Denver-area foster family awaiting adoption. Another dog living with Toll and Beck, a Chihuahua named Peanut, remains in the care of the Humane Society of Boulder.

A New Jersey man who admitted driving nails through a fence in hopes of injuring his neighbor’s dogs has been sentenced to 15 days in jail.

David Lench, 50, of Middletown also was ordered to pay $4,000 in fines when sentenced Wednesday by Middletown Municipal Court Judge Richard Thompson. He had pleaded guilty to three counts of animal cruelty.

Officials say Lench drove 18 3-inch nails through the a wooden fence separating his yard from Michael Flynn’s, which led one of Flynn’s three German shepherds to suffer puncture wounds to its face.

Neither Lench nor his lawyer, Michael V. Gilberti of Red Bank, could be reached for comment Wednesday, according to an Associated Press report.

The Oregon man who used a hammer to try to euthanize his daughter’s dog, then buried it alive, has been sentenced to 120 days in jail for misdemeanor animal abuse.

Hyrum Long, 75, of Forest Grove, said Tuesday he was trying to euthanize the dog in October when he hit it on the head with a hammer and buried it up to its neck. The dog, named Molly, was rescued by police but later euthanized by a veterinarian because of injuries and apparent long-term neglect.

Judge Rick Knapp called the situation “appalling” and told Long what he had done was “monstrous and barbaric.” Long, according to the Associated Press, also was sentenced to two years of probation and 100 hours of community service.

A California man who gave his girlfriend a 3-month-old yellow Lab for Christmas has been taken into custody.

Officials say the dog was stolen – three days before Christmas — from a Stanton pet store.

The theft of the Marley look-alike from Pet City was caught on the store’s surveillance cameras, according to the Orange County Register.

The boyfriend – Ryan Rickman, 23, of Orange – returned to the store with the dog to pay for it Tuesday, but instead was booked into county jail on suspicion of burglary and grand theft, officials said. Later, the puppy was turned over to Rickman’s girlfriend, who ended up paying for her own Christmas gift.

Sheriff’s investigators have identified a second man involved in the theft but have not been able to contact him, said an Orange County Sheriff’s Department spokesman.

Security video shows two men walking into the store and spending several minutes talking to clerks. After one of the clerks leaves for a lunch break, one of the men distracts the remaining clerk while the other man lifts the puppy from a cage and runs out the door.

Earl Simmons, better know as rapper DMX, faces at least 90 days in jail after pleading guilty on Tuesday to drug, theft and animal cruelty charges, Arizona prosecutors said.

The Baltimore-born Simmons, 38, pleaded to three felony charges and one misdemeanor count in Maricopa County Superior Court under a deal to settle three criminal cases against him. He also agreed not to own any animals or posses firearms.

His sentencing is scheduled for Jan. 30.

“I am pleased that this defendant will be held accountable for both his drug and animal cruelty offenses,” said County Attorney Andrew Thomas, in a statement.

The rapper turned actor has been battling legal woes during the past year in Arizona, according to Reuters. In May, he was arrested on drug and animal cruelty charges after sheriff’s deputies raided his home in Phoenix. Authorities found dog carcasses and malnourished pit bulls at the residence.

A German shepherd used to keep prison inmates in line escaped from his handler’s home Thursday night and ended up at the Beverly Golf and Tennis Club.

The Boston Herald reported that the dog, named Urek was found Friday morning “hanging around the veranda,” according to the club manager. “He was a pretty ominous-looking character,” she said. “I assume he had tags, but no one wanted to get close enough to look.”

Urek, trained employed by the Essex County Sheriff’s Department to attack on command, harmed no one.

A spokesman said Urek and his handler, K-9 officer Sgt. Mark O’Brien, are no longer partners — at least until an investigation into how the dog broke out is completed.

O’Brien notified area police when he discovered the dog missing. The sheriff’s department located him at the golf course less than a mile from his home.

I’m guessing that, alas, poor Urek just wanted a change of scenery.
